THE XPRESSBET® DIME-A-DAY SARATOGA ONLINE HANDICAPPING CHALLENGE
OFFICIAL RULES
The Tournament:
The XpressBet® Dime-A-Day Saratoga Online Handicapping Championship is a competition in which Players attempt to earn the highest mutuel payoff each day based on one (1) wager in the amount of ten dollars ($10) to win, place or show on one (1) horse in any pari-mutuel wagering race offered per day at the 2008 Saratoga meeting, currently scheduled from July 23 through September 1, 2008 (the “Tournament”). Provided all Tournament conditions are met, the Player who earns the highest mutuel payoff each day (the “Winner”) will earn $1,000, which will be deposited directly to the Winner’s XpressBet wagering account (the “Account”). The Saratoga race meet is scheduled for 36 racing days in 2008, subject to change without notice.
- Only entrants who register for the Tournament online at www.xpressbet.com within a reasonable and sufficient time prior to the close of wagering on the last day of the Tournament are eligible to participate in the Tournament (the “Players”). Players need to register only once to be eligible to compete each day of the Tournament. Entrants must provide their valid XpressBet account number, name, e-mail address (twice) and telephone number.
- There is a one-time $20 registration fee.
- Players must make a single $10 ‘live’ wager to win, place or show on one horse in any race during the Tournament on each day they choose to compete.
- Only online wagers on races during the Tournament, which are submitted by using the Contest Wager Pad, are eligible for the Tournament and prizes. Wagers placed using the traditional non-Contest Wager Pad or wagers placed by telephone do not qualify.
- Player Accounts will be credited with winnings for all Tournament wagers and debited for all losing Tournament wagers.
- One registration per Account holder only.
- Players may, but are not required to, compete each live racing day during the Tournament and there is no limit to the amount of times a Player may win a prize.
- In the event that there is a tie for the top mutuel payoff on any day of the Tournament, the $1,000 daily prize will be divided evenly between all tied eligible Players for such day.
An on-air HRTV host will play along in the Tournament and shall make mythical Tournament wagers. For each day during the Tournament that the HRTV on-air host has the top mutuel payoff based on the host’s mythical Tournament wager compared to the Players registered and playing in the Tournament, in addition to the prize awarded to the Player(s) with the top mutuel payoff, a separate $1,000 will be donated to a charitable organization chosen by HRTV for that day.
To Enter:
Players must register for the Tournament by following instructions on the homepage of the XpressBet website located at www.xpressbet.com. Players must have an XpressBet account in good standing. One (1) Account per person. One (1) Tournament registration per person.
Registered Players must place a single $10.00 ‘live’ win, place or show online wager on one (1) horse in any pari-mutuel race at Saratoga during the Tournament. Registered Players must use their online XpressBet wagering account to place wagers in order for the wagers to be eligible. Wagers must be submitted via the special Contest Wager Pad only to be eligible. Wagers submitted via telephone and the usual, non-Contest Wager Pad will not count in the Tournament and will not be eligible for prizes.
Wagers on scratched horses earn zero in the Tournament. If a Player notices that an already wagered horse is scratched in a particular Tournament race, the Player may submit a $10 win, place or show wager on another horse in that race before wagering closes for that particular race. Players must use the Contest Wager Pad to submit all Tournament plays including replacement plays for scratched horses. Once a late scratch is processed by the tote, the Contest Wager Pad will be available for submission of replacement wagers on scratched horses.
Entries must be made in accordance with these Official Rules; any other attempted form of entry will NOT be accepted. Any use of robotic, automatic, macro, programmed or like call-in or registration entry or wager methods will void all such entries by such methods, and result in disqualification of any entrant using such methods.
Tournament Dates:
The Tournament runs each live racing day at Saratoga Race Course, beginning July 23 through September 1, 2008, subject to change without notice. In the event the Tournament dates change, XpressBet will make reasonable efforts to post any such changes on the XpressBet website.
Legal and Eligibility:
The XpressBet® Dime-A –Day Saratoga Online Handicapping Tournament is offered only in the United States (where legal) and is open only to legal U.S. residents who have a valid XpressBet wagering account in good standing (of such jurisdictions where online account wagering and the Tournament are lawfully offered), 21 years or older as of July 23, 2008. With the exception of the HRTV on-air host(s) playing along in the Tournament for charity and making mythical wagers, Employees, officers and directors (and their immediate families [parents, children, spouses and siblings] regardless of where they live and members of their same households [whether related or not]) of XpressBet, Inc., its parent, subsidiaries, affiliates and agencies; and entities engaged in the development, distribution, implementation or administration of the Tournament are not eligible to enter. VOID WHERE PROHIBITED BY LAW.
YOU MUST HAVE AN OPEN, VALID XPRESSBET ACCOUNT IN ORDER TO REGISTER FOR THE TOURNAMENT. PERSONS WITH XPRESSBET ACCOUNTS THAT ARE CLOSED (UPON THEIR OWN REQUEST) OR WITH XPRESSBET ACCOUNTS THAT HAVE BEEN LOCKED BY XPRESSBET (BECAUSE ACCOUNT IS NOT IN GOOD STANDING) ARE NOT ELIGIBLE TO REGISTER FOR THE TOURNAMENT, UNLESS THEY RE-OPEN ACCOUNT IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF USE OF WWW.XPRESSBET.COM.

XPRESSBET IS NOT RESPONSIBLE FOR ANY DIFFICULTIES THAT MAY ARISE IN FUNDING YOUR ACCOUNT OR HAVING THESE FUNDS AVAILABLE FOR WAGERING DURING THE TOURNAMENT.
These are the official rules. This Tournament is subject to all applicable Federal and State law. These rules are subject to change without notice in order to comply with any applicable Federal and State laws. XpressBet shall make reasonable efforts to post changed information to its website.
To Establish an XpressBet Account:
XpressBet applications are accepted online at www.xpressbet.com; by calling toll-free (866) 889-7737; or in-person at an XpressBet center at any one of the following race tracks: Bay Meadows Race Course (San Mateo, CA), Golden Gate Fields (Berkeley, CA), Santa Anita Park (Arcadia, CA), Thistledown (Cleveland, OH), The Meadows (Meadowlands, PA), Suffolk Downs (East Boston, MA), Pimlico Race Course (Baltimore, MD), Laurel Park (Baltimore, MD). Follow all instructions, first providing your name, complete residential address (including zip code), telephone number, date of birth, social security number, email address and mailing address (if different from residential address). You will also be asked if you wish to receive email updates about XpressBet, Inc.; you may complete and submit the application (and register for the Tournament) without consenting to receive such email updates. If submitting application online, indicate your preference by either retaining or removing the checkmark from the designated box. Then, select a username and password, security question and answer, and PIN and Account password for your XpressBet account. Upon completion of these steps, and valid id check, you will be assigned a unique XpressBet Account Number. As part of the application procedure, you may then also activate your XpressBet account for wagering by depositing funds into the account. The Privacy Policy and Terms and Conditions of Use may be found at www.xpressbet.com by clicking on the appropriate links on the home page and certain other pages of the website.
Once the application procedure has been completed and your XpressBet account has been established, you may register for the Tournament by following instructions located on the homepage of the XpressBet website located at www.xpressbet.com.
Selecting Winner:
The Winner on each day of the Tournament will be selected from eligible Players who have placed valid wagers for each such Tournament day. Each day during the Tournament, the Winner(s) will the Player(s) with the highest pari mutuel winnings of the $10 ‘live’ win, place or show Tournament wager made for that day of the Tournament. In the event of a tie amongst any number of Players, the prize will be evenly split among such Players. All Winners will be determined by XpressBet, Inc. management, whose decisions are final and binding in all respects.
Prizes may not be substituted, transferred or assigned by Winners.
All decisions are final.
Taxes:
Liability for any and all federal, state and local taxes rests solely with the prize Winner(s).
Notification of Winners:
Winners will be notified daily via one of the following: e-mail or telephone. Names of Winners will be posted to the XpressBet web site daily.
Prizes/Odds of Winning:
Cash prizes will be deposited to each Winner’s XpressBet wagering account only once all Tournament conditions have been met.
Odds of winning are determined by number of eligible entries received for the Tournament.
General Conditions:
In order to be eligible to receive prize, the prize Winner is obligated, and by entering agrees, to execute an Affidavit of Eligibility, General Release of Liability, Indemnity and Publicity Consent (where legal), which is to be returned to XpressBet within the indicated time period. Non-compliance with this requirement or return of prize notification as undeliverable will result in disqualification and prize forfeiture, with an alternate Winner being selected from the eligible Player with the next highest pari mutuel winnings for that Tournament day.
By accepting prize, Winner agrees to the use of his or her name, voice, photo, biographical information and/or likeness for promotional/advertising/trade purposes by XpressBet, Inc. and will be required to participate in such publicity communications as XpressBet, Inc. requests without further compensation, except where prohibited by law.
Indemnification:
By registering for the Tournament, each Player (i) agrees to abide by and be bound by these Official Rules and all decisions of XpressBet and the judges, which are final and binding in all respects; and (ii) releases and holds harmless XpressBet, Inc., its parent company, affiliates and each of their respective directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, or participation in this Tournament.
Limitations of Liability:
XpressBet, Inc. assumes no liability for typographical or other errors in the offer or administration of the Tournament including, without limitation, errors in the printing of the offer and official rules, selection, notification and announcement of the Winners, or distribution of the prizes.
XpressBet, Inc., its parent company, affiliates and each of their respective directors, officers, employees and agents shall assume no liability of any kind whatsoever in any cases in which their inability to act results from an event or situation beyond their control, including, but not limited to Acts of God, civil or military authority, acts of public enemy, war, riot, civil disturbance, fire, explosion, earthquake, flood, strike, third party non-performance lockout, labor disturbance, or any other cause beyond the control of a party. In such event, XpressBet, Inc. reserves the right to modify, suspend, or terminate the Tournament and award the prizes, as set forth in Modification/Suspension/Termination below. No responsibility is assumed by XpressBet, Inc. for late, lost, misdirected, damaged, incomplete, or illegible registration submissions, unaccepted Tournament wagers, postage due mail, disconnected, inaudible, interrupted phone calls, any computer, telephone, cable, satellite, network, electronic or Internet hardware or software malfunctions, failures, connections, availability or garbled or jumbled transmissions, service provider/Internet/web site/use net accessibility or availability, traffic congestion or unauthorized human intervention. XpressBet, Inc. reserves the right, in its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Tournament or web site; to be in violation of the Terms and Conditions of Use of the web site, or to be acting in violation of these Official Rules. XpressBet, Inc. is not responsible for any incorrect or inaccurate information, whether caused by web site users or by any of the equipment or programming associated with or utilized in the Tournament and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the web site.
Modification/Suspension/Termination:
If, for any reason, any component of the Tournament is not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which XpressBet, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of any components of the Tournament (the “Fault”), XpressBet reserves the right in its sole discretion to modify or suspend the Tournament and select the winners based on entries received up until the time of the Fault. XpressBet reserves the right, but in any event shall not be obligated, in the event of a Fault, to change the means of entry and participation in the Tournament by means other than via online entry and participation for the duration of the Tournament or until the Fault is corrected. In such event, notice will be posted at www.xpressbet.com. Notwithstanding the foregoing, XpressBet may, in its sole discretion, in the event of a Fault, choose to terminate the Tournament without liability to any of the Players, except all registration fees shall be refunded and any amounts wagered on races that have not run shall be refunded to the Player’s Account.
